Welcome to Fitcentive, developed by Fitcentive LLC. These terms and conditions govern your use of our app and its services. By accessing or using the app, you agree to these terms and conditions. If you do not agree to these terms, please do not use the app.

1. Acceptance of Terms

By using the Fitcentive app, you agree to these terms and conditions. Fitcentive LLC reserves the right to modify or update these terms at any time. Users will be notified via email whenever there are updates to the privacy policy or terms and conditions. Your continued use of the app following any updates constitutes your acceptance of the revised terms.

2. Eligibility

To use the Fitcentive app, you must be at least 18 years of age or the age of majority in your jurisdiction, whichever is older. By accessing or using the app, you represent and warrant that you meet this eligibility requirement.

3. Data Use and Privacy

Fitcentive respects your privacy and is committed to protecting your personal data. Fitcentive integrates with third-party biometric devices, including Whoop, to collect and analyze fitness data. By using Fitcentive, you consent to the collection and processing of data from these devices.

  • We do not sell or monetize your data.
  • We do not share your personal data with third parties without your explicit consent.
  • Fitcentive is not liable for any loss of data.
  • Your data is processed in accordance with industry best practices in security and privacy protection.
  • Fitcentive is not responsible for the accuracy or completeness of data received from third-party biometric devices, including Whoop.

4. Fitcentive Challenges

Challenges within Fitcentive are structured competitions based on biometric performance metrics.

  • Challenges can be one-on-one or group-based, requiring users to deposit points toward a target metric.
  • Winners are users who achieve the target metrics. Losers and users who fail to meet the metrics forfeit their deposit.
  • Challenge payouts are issued within one week of completion.
  • Users have 48 hours after a Challenge ends to sync their data.
  • If you fail to sync your data within this period, Fitcentive is not responsible for incomplete challenge data, and the final results will be based on the available data.

5. Preventing Fraudulent Activity

To maintain fairness, Fitcentive enforces strict anti-fraud measures. Attempting to manipulate the system will result in account suspension. Prohibited activities include:

  • Machine-powered assistance to artificially enhance metrics.
  • GPS spoofing or location-based manipulation.
  • Using multiple accounts or devices to game results.
  • Attaching biometric devices to anything other than your own body.
  • Unrealistically high and consistent point earnings over extended periods.

Users found violating these policies will be subject to suspension or permanent bans.

6. Reward Rates

Fitcentive reserves the right to adjust:

  • The number of points awarded per activity.
  • Monthly point distribution rates.
  • Reward percentages.

Any changes will be communicated in-app or via email.

7. Liabilities

Fitcentive is not liable for:

  • Lost points or funds due to improper data syncing or failure to update account details.
  • Any inaccuracies in third-party biometric data.
  • Non-refundable entry fees for challenges.

Users assume all risks associated with fitness challenges and biometric tracking.

8. Right to Cancel Accounts

Fitcentive reserves the right to:

  • Suspend or terminate any account suspected of fraudulent activity.
  • Withhold payments to users with unusual activity until further review.
  • Request additional verification on challenge results or biometric data.

9. No Medical Advice

The Fitcentive app provides insights and data analytics based on biometric tracking. However:

  • Fitcentive does not provide medical advice.
  • The app should not be used for diagnosis, treatment, or prevention of any medical conditions.
  • Always consult a licensed medical professional before starting any fitness or health regimen.
  • Use of the Fitcentive app does not establish a doctor-patient relationship.

Users assume all risks associated with physical activity, and Fitcentive is not liable for injuries or health-related issues resulting from app usage.

10. Payment

  • Fitcentive may offer paid memberships, challenge entry fees, or other in-app purchases.
  • Fees are non-refundable unless explicitly stated otherwise.
  • Users are responsible for ensuring payment methods are up to date.

11. Termination & Account Deactivation

Fitcentive reserves the right to modify, suspend, or discontinue the app at any time. Users may delete their accounts, but data may still be stored for compliance or operational purposes.
